Welcome to WeKonneck! These Terms and Conditions (“Terms”) govern your access to and use of the website, mobile applications, and services (collectively, the “Platform”) provided by WeKonneck Marketplace Inc. (“WeKonneck,” “we,” “us,” or “our”).
By registering an account, browsing, purchasing, or listing items for sale on the Platform, you (“User,” “Buyer,” or “Seller”) agree to be bound by these Terms. If you do not agree to these Terms, you must immediately stop using the Platform.
1. The Nature of the Platform
WeKonneck Marketplace Inc. provides an online e-commerce marketplace platform that allows independent third-party sellers (“Sellers”) to list, advertise, and sell products, and buyers (“Buyers”) to browse and purchase those products.
- WeKonneck facilitates the platform and payment processing but is not the seller of record, manufacturer, or distributor of any products listed by third-party Sellers.
- Any contract for the sale of an item is strictly between the Buyer and the Seller. WeKonneck is not a party to that transaction.
2. Eligibility and Account Registration
Global Access: The Platform is accessible globally. Users must comply with all local laws regarding online conduct and acceptable content in their respective jurisdictions.
Age: You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Platform.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
3. Seller Obligations and Commitments
Sellers who list products on WeKonneck agree to the following:
- Accuracy: You must provide true, accurate, and complete descriptions, pricing, and shipping information for all items listed.
- Compliance: You ensure that your products do not violate any local or international laws, intellectual property rights, or WeKonneck’s Prohibited Items Policy.
- Fulfillment: Sellers are independently responsible for shipping, delivery, customs compliance, and handling returns or exchanges in accordance with their stated policies.
4. Buyer Terms, Pricing, and Payments
Transactions: When buying an item, you agree that you are entering into a legally binding contract with the Seller.
Currency and Taxes: Prices are displayed as indicated on the Platform. Buyers are responsible for any applicable sales taxes, customs duties, import fees, or tariffs associated with cross-border shipping.
Payment Processing: Payments are securely processed through third-party payment gateways. By purchasing, you authorize these processors to charge your selected payment method.
5. Platform Fees and Commission
WeKonneck charges transaction fees, listing fees, or commissions to Sellers for utilizing the Platform. These fees are detailed in the Seller Portal and are subject to change. Fees are non-refundable unless otherwise stated
6. Intellectual Property
Our Content: All content, branding, logos, software, and designs on the Platform are the exclusive property of WeKonneck Marketplace Inc.
User Content: By uploading product images, descriptions, or reviews, Sellers and Buyers grant WeKonneck a non-exclusive, worldwide, royalty-free license to use, host, and display that content for marketing and operational purposes.
7. Prohibited Conduct
Users agree not to:
- Use the Platform for any fraudulent or illegal activity.
- Circumvent WeKonneck’s checkout process to complete sales off-platform (disintermediation).
- Harass, abuse, or mistreat other Users or WeKonneck staff.
- Deploy bots, scrapers, or malicious code against the Platform.
8. Limitation of Liability and Disclaimers
“As-Is” Basis: The Platform is provided on an “as-is” and “as-available” basis without warranties of any kind.
Product Liability: WeKonneck explicitly disclaims all liability for the quality, safety, legality, or delivery of products sold by third-party Sellers.
Maximum Liability: To the maximum extent permitted by applicable law, WeKonneck Marketplace Inc. shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Platform.
9. Indemnification
You agree to indemnify, defend, and hold harmless WeKonneck Marketplace Inc., its directors, officers, and employees from any claims, losses, or demands (including legal fees) arising out of your violation of these Terms, your misuse of the Platform, or your infringement of any third-party rights.
10. Governing Law and Jurisdiction
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles. Any legal action must be filed in the courts located within that jurisdiction.
11. Modifications to the Terms
We reserves the right to modify these Terms at any time. We will notify users of significant changes by updating the “Last Updated” date at the top of this document or via email. Continued use of the Platform after changes are posted constitutes acceptance of the new Terms.
